$3.65 Million Jury Verdict

August 2022: Atkins & Walker Law obtained a $3.65 million jury verdict in a medical malpractice case in Albuquerque, New Mexico.  Atkins & Walker Law pursued a medical malpractice suit against a podiatrist’s corporate practice group for negligently cutting a patient’s nerve and tendon during a procedure.  The patient, our Client, saw the podiatrist for a non-cancerous growth on the bottom of his left foot.  The podiatrist recommended surgery, which took place less than a month after the initial visit, without any efforts or recommendations of conservative care.  After the surgery, the Client immediately suffered severe pain and an inability to flex his big toe.  The Client underwent extensive diagnostics and treatment to address these symptoms but ultimately had to undergo a below-the-knee amputation of his leg due to the damage.

Atkins & Walker Law sued the podiatrist’s corporate practice group, claiming that the podiatrist had negligently severed our Client’s tendon and nerve during the fibroma removal surgery.  The defense claimed that our Client’s conditions were “known complications” of the surgery.

 Atkins & Walker Law took the case to trial in August 2022.  After a week-long trial, the jury found the podiatrist was negligent and awarded our Client $3.65 million in permanent disfigurement, pain/suffering, and lost enjoyment of life damages.
